Total LSAT Prep maintains this website, any courses offered and other linked and related sites (the “Site”) for the use of its customers, vendors, students, and other Site users (“Users”) upon agreement to the following terms. Please read the terms carefully before using the Site. Use of this website indicates acceptance of these “Terms of Service” and forms a binding agreement between you and Total LSAT Prep. If you do not agree to these terms, do not use this Site.

Liability Limitation

Total LSAT Prep makes no warranties or representations as to the performance or merchant ability of the products or services referred to on this web site. Total LSAT Prep is not liable for any damage to hardware or software by anyone accessing this web site, or for loss of business or profits, or for any consequential damages made by any party using the information on this web site for any cause whatsoever, regardless of the form of action.

Third Party Web Site Links

Total LSAT Prep provides links to third party web sites for use by interested parties. Total LSAT Prep is in no way affiliated with these third parties and makes no representations regarding these sites or use of products or services from these sites. We do not endorse any product or service or its appropriateness. We have not confirmed the accuracy or reliability of any of the information contained on any third party’s site.

Warranties

Total LSAT Prep makes no warranties or representations regarding the information provided by third parties or to the performance or the merchant ability of the products or services referred to on third party sites. We do not make any representations or warranties as to the privacy or security of any information, including credit card information, you may be requested to give to a third party.

Use of Site

Total LSAT Prep provides various materials, information, quizzes, tests, questions, articles, news and other information on this and related sites and in courses offered through this site (the “Materials”). Total LSAT Prep provides various videos in courses offered through this site (the “Videos”). Total LSAT Prep authorizes each User to view the Videos only. Users may not modify the Materials at this Site in any way or reproduce, share or distribute them. Users will keep all Materials confidential, and will not sell, auction, loan, rent, give away, describe, summarize, or otherwise reveal the Materials or their contents, to any other person or entity. Total LSAT Prep may provide Users with access to Materials for limited period after initial registration. Any breach of these Terms of Service automatically terminates your authorized use of the Site. Total LSAT Prep provides information and guidance about law school admissions in its Materials. Total LSAT Prep does not make any warranty of any kind (expressed or implied) as to the results that may be obtained from use of its Materials. In particular, Total LSAT Prep does not guarantee that the Materials will improve your chances of admission to law school, or that you will be admitted to any law school. Total LSAT Prep is not responsible for any loss, injury, claim, liability, or damage (including rejection from any law school) related to your use of the Materials, whether it be from errors, omissions, advice, or any other cause whatsoever. Your use of the Materials is at your own risk.

User Warranty

As a User you warrant that you are not an agent or employee of any other test preparation company and using the Site and Materials solely for the purpose of increasing your LSAT score, law school admissions, law school grades, or MBE score.

LSAT Course Refund and Cancellation Policy

Subscriptions can be canceled at any time and are not refundable. You keep whatever time you already purchased. For example, if you sign up on May 21st and you decide that you want to cancel on June 2nd, you’ll still have access until June 20th. LSAC LawHub Advantage subscriptions are required by LSAC in order to use our course and are refundable only if they have not been activated.

Revision of Terms of Service

Total LSAT Prep may at any time revise these Terms of Service by updating this posting. By using this website, you agree to be bound by any such revisions and should therefore periodically visit this page to determine the then current Terms of Service to which you are bound.

All materials, names, and terms on the Site are the property of Total LSAT Prep except where otherwise noted. Tutoring Terms of Service

Tutoring Service Definition

Total LSAT Prep’s Tutoring Services shall consist of remote instruction and, from time to time, other forms of support in order to help the Client prepare for the Law School Admissions Test (LSAT).

Tutoring Hours, and How They’re Serviced

After a Client purchases a 5-Hour, 10-Hour, or 20-Hour Package, the Client is entitled to five, ten, or twenty Tutoring Hours. If the Client purchases a package denominated by some other number of hours—say, N hours—the Client is likewise entitled to N Tutoring Hours. Total LSAT Prep shall service each Tutoring Hour with an hour of Scheduled Simultaneous Instruction. “Simultaneous Instruction” means live remote instruction conducted via Skype or some other electronic platform, and by a Tutor affiliated with Total LSAT Prep. Something is “Scheduled” if it is conducted in accordance with a plan to which both the Tutor and Client have agreed. Total LSAT Prep is not obligated to provide service that is not Scheduled, although Total LSAT Prep may from time to time be willing to Schedule something on short notice. Total LSAT Prep is not obligated to provide help via email or any means other than Simultaneous Instruction, though Total LSAT Prep may from time to time be willing to do so. In some cases, Total LSAT Prep will deduct the time a Tutor spends on such activities from the Client’s Tutoring Hours, though Total LSAT Prep will never do so without the Client’s permission. Emails primarily pertaining to the Scheduling of Simultaneous Instruction will never count as Tutoring Hours.

Human summary: If you buy, say, ten hours of tutoring, you get ten hours of live instruction, but you don’t get unlimited help via email. We might respond to emailed questions off the clock, but we reserve the right to tell you that our responses will have to be on the clock. Emails about scheduling are never on the clock.

Time Period and Scope of Tutoring Services

The Tutoring Services shall expire when Total LSAT Prep has serviced the Client’s Tutoring Hours or a year after the Client’s purchase of said Tutoring Services—whichever comes sooner.

Scheduling Considerations

A Scheduled session of Simultaneous Instruction is a Tutoring Session. A Business Day is a day that does not fall on the weekend or on an American Federal holiday. Total LSAT Prep cannot guarantee the Client a Tutoring Session on a day that is not a Business Day. If a Client requests a Tutoring Session that has not been previously Scheduled, Total LSAT Prep cannot guarantee that it will be able to accommodate such a request in fewer than four Business Days.

Human summary: After you initially schedule your sessions with us, we may need about a week’s lead time if you need to reschedule. We might not be able to work on weekends or holidays unless you arrange it with us beforehand.

Lateness, No-Shows, and Rescheduling Policy

Unless the Client cancels or reschedules, Total LSAT Prep will deduct the duration of a Scheduled Tutoring Session from the Client’s Tutoring Hours, whether or not the Client attends all or part of said Scheduled Tutoring Session. If the Client fails to attend a Scheduled Tutoring Session within 20 minutes of the Tutoring Session’s start time (or 10 minutes of the Coach Session’s start time), Total LSAT Prep shall consider the Client to be a No-Show and will not continue to wait for the Client. Total LSAT Prep will deduct the full time of the Scheduled Tutoring Session from the Client’s Tutoring Hours. Total LSAT Prep requires 24 hours of notice to cancel or reschedule a Scheduled Tutoring Session.

Human summary: We require 24 hours to reschedule or cancel a session. If you don’t cancel or reschedule, we’ll deduct a scheduled session from your total time, even if you’re late or a no-show. We’ll wait for you for 20 minutes (or 10 if it’s Coach).

Confidentiality

Total LSAT Prep Tutors may share the Client’s information with other Total LSAT Prep Tutors or affiliates of Total LSAT Prep for the purpose of better serving the Client. Total LSAT Prep shall in all other respects keep the Client’s personal information and test scores confidential unless Total LSAT Prep is compelled to divulge information by a sovereign legal authority.

Timely Replies

Total LSAT Prep will make a good-faith effort to respond to the Client’s emails in a timely fashion and within 48 hours of receipt. After a Client purchases Tutoring Services, Total LSAT Prep shall send the Client an Intake Form. Within 48 hours of the Client’s completion of the Intake Form, Total LSAT Prep shall match a Client with a Tutor, and the Tutor shall reach out to schedule an introductory, off-the-clock meeting with the Client.

Human summary: You’ll hear from us within 48 hours of submitting your intake materials.

Refund Policy

Total LSAT Prep shall give the Client a full refund (minus a 6% processing fee) upon request within 14 days of the Client’s purchase so long as the Client has (1) used one hour or less of the Tutoring Services and (2) purchased more than one hour. Total LSAT Prep does not offer refunds on one-hour packages that the Client has used. Total LSAT Prep does not offer refunds on unused sessions or services.

Human summary: You can test-drive us for an hour and still get your money back (minus 6% for processing) within 14 days. We don’t give refunds of unused sessions.

Chargebacks

In the event that the Client initiates a chargeback dispute with their credit card issuer or financial institution regarding any payment made to Total LSAT Prep under the terms of this Agreement, Total LSAT Prep shall immediately terminate all services provided under this Agreement.

Human summary: If you dispute our charge to your credit card, we’ll immediately cease providing you with services.

No Guarantee of a Score Increase

Total LSAT Prep makes no guarantee, either implicit or explicit, that the Client’s score will increase either on official or practice LSAT tests after using these Tutoring Services.

Termination

In the event that Total LSAT Prep is unable to complete its obligations under the terms of the contract, Total LSAT Prep retains the right to terminate this agreement at any time and refund the Client on a prorated basis.

Recorded Sessions

Total LSAT Prep will record Tutoring Sessions for the purpose of improving the Tutoring Services. Copies of the recording may be requested by any student who is featured in the video.

LawHub Subscription Sold Separately

A purchase of Tutoring Services does not include access to LSAT LawHub Advantage from LSAC. This is required to use Total LSAT Prep Tutoring Services.

Chargebacks

In the event that the Client initiates a chargeback dispute with their credit card issuer or financial institution regarding any payment made to Total LSAT Prep under the terms of this Agreement, Total LSAT Prep shall immediately terminate all services provided under this Agreement.

Termination

Total LSAT Prep reserves the right to terminate this Agreement at any time if the Client misrepresents facts about themself, acts egregiously, becomes hostile, proves impossible to satisfy, maintains unreasonable expectations, or makes unreasonable demands despite Total LSAT Prep’s good-faith efforts. In such cases, Total LSAT Prep shall refund the Client on a prorated basis.

Acknowledgments

The Client’s LSAT scores, undergraduate GPA, professional background, disciplinary record, and many factors over which Total LSAT Prep has no control will constrain and affect the Client’s chances of admission to law school. Total LSAT Prep makes no guarantee, either explicit or implicit, that the Client will be admitted to any particular law school.

Law school application requirements and the processes by which law schools admit applicants may change from year to year, and Total LSAT Prep may from time to time be unaware of such changes.

The application to Yale Law School asks if you received assistance in preparing your application. If the answer is “yes,” Yale asks you to specify from whom you received the assistance, the nature of the assistance, and whether or not you paid for the assistance. Answering “yes” may impact your chances of acceptance to Yale.

No Warranty

Total LSAT Prep provides, in addition to the aforementioned Services, information and guidance about law school admissions in the form of online lessons, videos, webinars, documents, and other forms of communication (“Materials”). Total LSAT Prep does not make any warranty of any kind (expressed or implied) as to the results that may be obtained from use of its Materials or Services. In particular, Total LSAT Prep does not guarantee that the Materials or Services will result in acceptance to law school or any other academic institution, or that the Materials or Services will result in an offer of financial aid. Total LSAT Prep’s Materials and Services are provided “AS IS,” and Total LSAT Prep does not guarantee that they are accurate or current.

Legal Stuff

Severability

If any provision of this Agreement is void or unenforceable, such provision shall be deemed omitted and the remainder of this Agreement shall remain in full force and effect.

Assignment

Total LSAT Prep shall have the right, at its election, to assign this Agreement to any person, firm, or corporation, including all Total LSAT Prep employees, contractors, shareholders, parent entities, subsidiaries, and affiliates. The Client may not assign its rights under this Agreement under any circumstances.

Integration

This Agreement constitutes the sole Agreement of the parties hereto and correctly states the rights, duties, and obligations of each party. Any prior agreement, promises, negotiations, or representations between the parties not expressly stated in this document are not binding. All subsequent modifications shall be in writing and agreed to by both parties.

Indemnification

Total LSAT Prep is not responsible for any loss, injury, claim, liability, or damage (including a rejection from any law school or a decrease in the Client’s LSAT score) related to the Client’s use of the Materials or Services. The Client agrees to protect, indemnify, save, defend, and hold harmless Total LSAT Prep, its affiliates, subsidiaries, parent entities, and partners, and each of their assigns, agents, representatives, officers, directors, shareholders, contractors, and employees from and against any and all expenses, damages, claims, suits, actions, judgments, costs, and expenses whatsoever (including reasonable attorney’s fees), arising out of, or in any way connected with (1) any breach of this Agreement; and/or (2) any acts or omissions of the Client. In the event Total LSAT Prep expends any monies in an effort to enforce the terms and conditions of this Agreement, the Client shall reimburse Total LSAT Prep for all of the said costs and expenses (including reasonable attorney’s fees).
